Injury During Regularly Scheduled Breaks from Work

If you are hurt during a regularly scheduled break at work, you will not have a claim for a job injury. There could be exceptions which will be based on the degree of control the employer has over you while you are on the break or whether you have complete control over your break time. Do not let an adjuster of your HR department discourage you from exploring your entitlement to workers' compensation benefits or receiving medical care, if you were hurt while on a break from your duties at work.
