What Is the Biggest Concern Ahead of Going to Court?

Burdine & Brown July 24, 2024

What is the biggest concern of anyone who is headed into a legal fight in court, before court? It is, beyond doubt, the perception of fairness, impartiality, justice and maybe, when all is not going well on your side, mercy.

But if your legal case is “in the tank”, you would still expect fairness and impartiality on the part of the lawyers involved.

In my law practice in Suwanee, Georgia, I represent the injured worker, the automobile accident victim and the disabled seeking Social Security Disability benefits. My clients are examined by orthopedic doctors and sometimes it is very obvious how biased they are. The longer I represent good quality folks, and the more my clients are required by the insurance companies and their lawyers to attend medical “independent” appointments, the easier it is to see who is fair and impartial and who is clearly not impartial. Goodness, even my clients can pick up on the lack of fairness and impartiality. This tends to erode the system of justice where we all are seeking the truth of the matter.

Now let’s take a look at the Georgia case against Former President Donald Trump, brought by Fulton County District Attorney, Fannie Willis. There is so much information coming out through the national and local news media that looks more and more like this public figure has long ago abandoned fairness and impartiality. It has been discovered that she hired her lover to be lead prosecutor, ignoring that he has absolutely no experience in handling complicated, racketeering cases. For the record, this assistant DA has only a very small amount of experience in automobile accident cases, name changes and some divorce work. Using tax payer money to travel with Fannie to multiple places around the world is not what one would call a fair and judicious use of the outrageous salary he has received to date (reportedly at $700,000).

Ms. Willis authorized this associate DA to travel to the White House where, for over 16 hours, he collaborated with the backroom leaders of the Biden Administration. Why did he need to meet with The White House to discuss the Georgia case? Fairness, justice and impartiality flies out the windows. Collusion to destroy a political opponent is at the heart of the matter.

Don’t some of these actions not sit well with you? Doesn’t it seem that there is a hidden agenda here?

Interestingly, there is a divorce case between Fannie’s appointment of her assistant DA and his wife. The wife’s lawyer wants to know about the money her soon to be “X” is spending. The theory is that when you are in the middle of a divorce, you cannot be spending joint money indiscriminately. Until the divorce is final, all money is joint money. Yet, that is what he was doing, again, with Fannie. And quite boldly and in public.

Did the two of them think they would not be discovered? Did they think they were above the law? Plane tickets were discovered for the two of them taking multiple trips all over the world. The arrogance of the two of them is extraordinary.

There is also the public trust of these officials, who are allegedly attempting to do the public’s (you and me) business. Doing these things, behind closed doors, only to be discovered in divorce litigation, not by a voluntary disclosure by these officials, is abominable.

I submit that a prosecutor has a duty to act with fairness and impartiality. This is not taking place with Fannie Willis, Futon County’s DA. Her goal is to prosecute former President Trump and to ban him from the ballot, depriving all voters of their right to choose in the upcoming Presidential Election.

The DA’s ethics are completely questionable, and frankly off the charts. She should be forced to step down and maybe even withdraw all charges against former President Trump and the many others she seeks to destroy. She should soon be disbarred from practicing law in the State of Georgia.

The Court of Appeals will soon address this issue as this case if before them in August of 2024.
